Perm Labor Certification Application

PERM stands for Program Electronic Review Management and is the current method of Labor Certification required for many of the categories of obtaining a green card through employment.  It is an internet based process that is used by the United States Department of Labor to certify to the United States Citizenship and Immigration Services (USCIS) that there are no qualified U.S. workers able, willing, qualified and available to accept the job at the prevailing wage for that occupation in the area of intended employment and that employment of the foreign national will not adversely affect the wages and working conditions of similarly employed U.S. workers.

The PERM procedures, which were introduced on March 28, 2005, were designed to expedite the Labor Certification process and streamline the process.  Unless there is an audit, the Department of Labor generally adjudicates most cases within 45-60 days.

In most cases of obtaining a green card through employment, the employer will need to file the Labor Certification and have it approved by the Department of Labor prior to submitting a petition on behalf of the foreign national with the USCIS.
